Abstract

In the present work an analysis of the legal status of higher education law in the countries of Nicaragua and Chile is made, and as the postulates of neo-managerialism advocate a high quality education in all educational levels, however, they are more that a utopia because in the Chilean case the right to education is trafficked as a commodity with the aim of profiting. Therefore, it is necessary that the human right to higher education is constitutionalized as a fundamental right, by virtue of which the State is obliged to provide this service by promoting its gratuity in public education establishments ensuring equal access to education for all the students.
